The Constitution aims to be flexible and provide for the basic functions for regional government - it should not dictate everything and cannot foresee every situation or event. Parliament, and by extension - the region as a collective, would be, and should be, the ultimate decision maker, not the Constitution itself, or any one nation.

I agree with most of what you said, however, for something as critical to the functioning and security of a region as the WA delegate, it is crucial to have clear guidelines in the constitution on how that position is filled. If we find it needs to be changed later on, we can hold a vote to change that aspect of the constitution as laid out in 1.14

I agree with you. In an ideal world we wouldn’t have this issue - we would have a founder.

The issue with the World Assembly Delegate is that elections happen for that position every 12 hours, whether we want them too or not.

On top of that, Nations are free to endorse nations at any time and thus, due to the constraints of the system, it would make any WA delegate election extremely hard to administrate.

I agree that anything surrounding WA delegates would be tough to enforce, but other regions have successfully achieved a mandatory endorsement policy pretty well. And as long as we are without a founder, a clear policy surrounding the delegate, even if tough to administer, is better than none

Really if the majority of regions have a functioning mandatory endorsement policy then I don’t see how ours would be an issue as well

What do people think of this system for WA delegates:

A term of a WA delegate is six months. Before the end of their term, a WA delegate must nominate a successor (can be any member of parliament except the current WA delegate themselves)

That successor must revive at least 60% of the vote in parliament to be approved. Once the six month term is up, the approved successor becomes WA delegate.

Once they have one term of being WA delegate, a former WA delegate cannot be delegate again for two terms (1 year)

Dear nations of the CISB,

Every nation in CISB is extremely saddened to see the loss of our founder, Pascala and the nation of Missisquoi. They were the glue that held this region together, the rock that bound this community together.

We all remember the CISB for what it was, a vibrant community where friendships were fostered and a unique bond existed within our community. An old guard, a brotherhood, of loyal nations remain.

But it is clear that we must re-energise ourselves, we must begin recruiting new members and inject activity into the region. I truly believe that without a change of course, the CISB will die a slow death.

Therefore, I wish to formally propose a constitution which establishes a limited, decentralised, regional government, with the aim of recruiting new members to the region and increasing regional activity.

The constitution establishes a Parliament, which will be the ultimate decision-making body. The term ‘election’ is used loosely. Parliament will consist of all nations in a newly created Civil-Register, and membership will be subject to residence in the region. Elections will be held to ensure accountability and to ensure that administrative tasks, such as procedure rules, and updates to the map, can be facilitated. The main focus, however, should be on recruitment efforts and regional activity.

As such, there shall be no ‘leader’ of our region. Parliament, and by extension the community, will be the leader, and we should take decisions collectively. We always have done. We may disagree on policy and argue, as we have done so in the past. Yet, I have known some of you for years, and here we remain.

I must be honest, I have concerns about opening our region back up again – without the founder, we are in danger of being raided. That is why some form of emergency powers will be required, but these must be fully explained and must retain the confidence of the region. We need to re-engage with one another if this is to be successful.

As we are currently in an ‘Anarchical Era’, with no functioning government, it seems only fair that this Constitution requires unanimity to be implemented. No one constitution will be perfect for everyone, that is why it the proposed Constitution is deliberately open ended.

We, the nations of CISB now hold power in the region. We shall make this region what we want of it. This region is my home on Nationstates, it is our home.

It is time we made the region feel alive again. It is time to end the ‘Anarchic Era’ of the CISB. Therefore, I humbly ask the current WA executive, Nogodia to establish a poll entitled ‘Should the Region Adopt the proposed Constitution’, with two options – Yes and No.

The Constitution should only be adopted if it is unanimously supported.

The poll should be up for the maximum length of time possible – 2 weeks - to ensure everyone’s voice is heard and everyone has time to vote on the proposal.

Preamble:

We, the nations of the CISB, to ensure regional stability, provide for the common defence, promote our community, and re-establish a limited regional government, do ordain and establish this Constitution.

1. All Legislative Powers herein shall be vested in a Parliament of the CISB.

2. Parliament shall be composed of all nations contained in the Civil Register. All nations in the Civil Register, expect for puppets, shall be entitled to one vote in Parliamentary proceedings.

3. Each Parliamentary Session shall last for three months and shall begin with an election for Speaker.

4. No nation may serve as the Speaker of Parliament for two consecutive Parliamentary sessions, unless such situation arises under Article 1, Section 10.

5. The Speaker of Parliament shall be in charge Parliamentary Business and Procedure, but Parliament must adopt general rules and procedures that can be amended by a three-fifths (60%) majority vote.

6. The Speaker of Parliament shall be the ultimate arbiter of Parliamentary Business and Procedure, but shall have no vote, unless Parliament be equally divided.

7. The Speaker of Parliament shall be granted Appearance, Communications and Polls authority.

8. To become Speaker, any candidate must secure the nomination of at least two nations entitled to vote in Parliamentary proceedings, and the support of an absolute majority of nations in Parliament.

9. In the event of a tied, or contested election, then Parliament shall not conduct any further business until a Speaker is elected.

10. If such situation arises whereby no Speaker of Parliament has been elected, but a Declaration of Emergency has been issued by the Guardian Council, and the region is in such imminent danger, then the previous Speaker shall temporarily chair Parliamentary proceedings, until such time whereby a new Speaker shall have been elected.

11. After a Speaker of Parliament has been elected, any nation entitled vote in Parliamentary proceedings, may nominate a candidate for any Cabinet Minister, as laid out in Article 2 of the Constitution.

12. Parliament may remove any Cabinet Minister, through a vote of no confidence, which may be called at the discretion of the Speaker. Any vote of no confidence requires the approval of at least three-fifths (60%) of Parliament.

13. Those powers not delegated to the Cabinet, or the Guardian Council, by the Constitution are reserved to Parliament.

14. Parliament may amend this Constitution through a two-thirds (66%) majority vote.

1. The Cabinet shall consist of three Cabinet Ministers, each appointed by, and accountable to Parliament.

2. The members of the Cabinet are as follows, and have the powers and authorities stated next to their respective portfolios:

- Minister of Recruitment: In charge of increasing region activity and recruiting new nations to the region and is granted Appearance and Communications authority.

- Minister of Information: In charge of maintaining up-to-date versions of the Constitution and all CISB legislation; and is granted Appearance and Communications authority.

- Minister of Role Play: In charge of enacting and administering role play guidelines along with updating the regional map; and is granted Appearance and Communications authority.

3. The Speaker of Parliament, along with the current WA Delegate, shall be ineligible to serve in the Cabinet.

4. As per Article 1, Section 11, any nation entitled vote in Parliamentary proceedings, may nominate a nation to serve in the Cabinet. No nation may nominate themselves to serve as a Cabinet Minister.

5. Before assuming their position, a candidate must win a vote of confidence in Parliament. A simple majority of support of those nations in Parliament shall suffice for a candidate to assume office.

6. The terms of Cabinet Ministers shall be the same as a Parliamentary Session, although unlike the Speaker, there shall be no term limits for Cabinet Ministers.

7. Each incumbent Cabinet Minister, at the start of a new Parliamentary Session, will need to renew their mandate through a vote of confidence in Parliament.

8. Membership on the Cabinet does not deprive a nation of the right to participate as a full voting member of Parliament.

1. The Guardian Council shall be solely in charge of Regional Security, and shall consist of the WA Delegate, members of the Cabinet, and the Speaker of Parliament.

2. The Guardian Council shall be able to conduct its business in private and will be able to issue a Declaration of Emergency by a simple majority vote.

3. Any Declaration of Emergency shall be subject to the confidence of Parliament every two weeks.

4. Any Declaration of Emergency shall have to secure the support of at least three-fifths (60%) of nations in Parliament to continue for another two weeks.

5. Parliament may lay a motion, of which at least three-fifths (60%) of those nations entitled to a vote in Parliamentary proceedings, may revoke a Declaration of Emergency at any time.

6. A Declaration of Emergency may be issued in the event that the region shall be in such imminent danger. Powers vested in Emergency Decrees include expelling nations from the region, password protecting the region and other powers that the Guardian Council sees fit.

7. The World Assembly Delegate shall be the chair The Guardian Council.

1. The World Assembly Delegate shall be granted all executive power, and all authoritative power.

2. The World Assembly Delegate shall be accountable to Parliament, and must adhere to any motion, or legislation, passed by Parliament.

3. The World Assembly Delegate is responsible for implementing the wishes of Parliament, supporting the Cabinet and shall be the chair of the Guardian Council, and shall be the ultimate arbiter of regional security.

4. The World Assembly Delegate, as the sole nation holding Executive authority shall have observer status in Parliament, and as such may participate in debates, but shall not be entitled to a vote in Parliamentary proceedings.

5. If given a lawful order by the Guardian Council, the World Assembly Delegate must use its executive powers to resist any attempts to invade, raid or destabilise the region.

6. The World Assembly Delegate may use its powers without prior authorisation from the Guardian Council, in such circumstances where the World Assembly Delegate reasonably believes that the security or stability of CISB is under threat. In these circumstances the World Assembly Delegate must provide a detailed written statement to Parliament justifying its actions. The Guardian Council, or Parliament, may order the World Assembly Delegate to reverse any action taken and, if so ordered, the World Assembly Delegate must comply with the order.

7. The World Assembly Delegate may not use its executive powers for any purpose or in any manner that is not contemplated by this Constitution or provided for under CISB law.
