ARTICLE I: THE REGION

Section I: Sovereignty

The Monarchy Alliance or TMA, is hereby declared to be a sovereign social and political congregation united under the nationstates region "The Monarchy alliance".

The seat of government and center of operations in the region of TMA shall be in the Discord site.

No foreign or domestic force may inflict upon the independence of TMA, nor claim sovereignty over any bodies legally under the possession of TMA.

Section II: Jurisdiction
The government of TMA shall have indisputable jurisdiction over the region of "The Monarchy alliance".

Any region of NationStates may be placed under the jurisdiction of TMA by Act of Senate.

The government of TMA shall have indisputable legislative authority over the NationStates region; however, all authority of ownership and adminship shall be derived exclusively from and by the authority of the Founder.

This may only occur if the individual in possession of the region consents to it.

The government of TMA shall have indisputable jurisdiction over any regions that are managed and owned by a TMA citizen that are primarily used for management and administration as part of the TMA government.

Regions declared as classified by someone with the authority to declare classification may exist without the consent or knowledge of the unauthorised members of the TMA government.

ARTICLE II GOVERNMENT:

Section I; The Crown, The Emperor and Founder (one and the same as Holy Roman Empires2)

His Majesty, the Emperor Holy Roman Empires2 shall serve for life, except for when the Emperor is on vacation, in which case he may temporarily grant executive power to another nation, excluding banning and kicking, or abdications.

The Emperor has a duty to run the roleplay, maintain the integrity of his office, create any further imperial offices he sees fit, and run recruitment.

His majesty the Emperor Holy Roman Empires2 may veto any legislation made by the Senate, as may the Chancellor, with may be overturned with a ⅔ majority

The Emperor shall have the authority to make appointments and dismissals of members of the House of Nobles.

National Emergency Clause:
The founder Holy Roman Empires2, may declare a national emergency in a mass exodus, or any other time that the two Emperors see declaring a national emergency fit. This power is to be used sparingly. In the case of a national emergency, the founder will take control of the region, and have broad powers, in a dire emergency. A national emergency may be lifted by the founder, or the Senate with a majority vote.

His Majesty, the Emperor Holy Roman Empires2 will have sole management over the roleplay, and shall appoint whoever he sees fit, with it being recommended he appoint a minister of roleplay

His Majesty, the Emperor Holy Roman Empires2 shall reserve the right to appoint, promote and dismiss junior officers, to serve the duties he sees fit.

Subsection I: Role

The Emperor is primarily responsible for maintaining order and stability within TMA in situations of emergency.

The Emperor is the highest authority within The Monarchy Alliance.

The Founder is considered the higher authority and shall have all executive, legislative, and judicial power that comes with the position with the region, however they are one and the same.

Subsection II: Powers and Responsibilities[/blue

The Emperor shall have the power to pardon violators of the law.

Any pardon may be contested by a motion of citizenry, which may be initiated by any citizen. If the motion achieves a two-thirds majority, among those present and voting, the pardon shall be struck null.

The Emperor shall have the power to grant exemptions to the citizenship applications.

Any exemption may be contested by a motion of the House of Nobles, which may be initiated by any officer thereof. If the motion achieves a one-half majority, the exemption shall be struck null.

The Emperor shall be responsible for conducting all elections. The Emperor shall be the Commander-in-

Chief of the Royal Armed Forces and all of its affiliates.

Subsection I: Role
The Doge shall serve as the Speaker of the Senate and the highest executive authority. He shall be elected by the Senate, and may be removed by the Senate.

Subsection II: Responsibilities

The Doge shall be responsible for presiding over the Senate.

In the absence of the Doge, the Emperor will serve as Speaker.

The Doge shall hold the authority of the Chancellor in the absence of a Chancellor if the Minister of
Defense or Foreign Secretary cannot.

Subsection IV: Requirements and Selection

For any person to assume, hold, or run for the office of Doge, they must have been a citizen for a period of two consecutive weeks and a Senator for at least one month.

The Doge shall be elected every eight weeks by manner of Single Transferable Vote.

If the Doge resigns, an election shall be held.

Section III: The Chancellor

Subsection I: Role

The Chancellor shall be the Head of the House of Nobles and head of the government.

Subsection II: Responsibilities

The Chancellor shall be responsible for the coordination of the House of Nobles and the resolution of all disputes between ministers.

The Chancellor shall be responsible for ensuring that all ministers are carrying out their duties effectively and taking necessary action if that fails to be the case.

The Chancellor shall be responsible for the public representation of the Nobles and government in all public matters.

The Chancellor shall be responsible for assisting and protecting the due integrity of the staff and the enforcement over all manner of conduct.

The Chancellor shall be responsible for appointing the following Ministers with Officer Power:

The Minister of Foreign Affairs (with the power to close emabassies once consulting the Emperor and the Chancellor, who may decide otherwise, shall appoint all foreign ambassadors, conduct foreign affairs, and maintain and public image deemed needed)

The Minister of Defense, (with the power of organizing the TMA militia, its tanks thereof, its Officers and Ranks, its exercises and WA practices in according of TMA interests and her allies. May only conduct war with the permission of the Senate.

Subsection III: Executive Powers

The Chancellor shall have the power to classify, declassify, or reclassify any information.

The Chancellor shall have the power to dismiss a Minsiter.

Subsection IV: Requirements and Selection[/blue]

For any person to assume, hold, or run for the office of Chancellor, they must be a citizen of TMA for a period of one consecutive week.

The Chancellor shall be elected at the beginning of each month by the citizens at-large in a Single Vote election.

In the case of resignation or removal, the Chancellor shall be re-elected traditionally, serving until the conclusion of the beginning of the following month; during this period of time, an interim Chancellor shall serve, a minister chosen by the Emperor.

The Chancellor may be removed by motion of the Senate, which may be initiated by any citizen. If the motion achieves a two-thirds majority, the Chancellor shall be removed from office.

Section IV: The Senate

The Senate shall be the body responsible for the creation of laws binding the structure, power, and responsibilities of government and civilian conduct within TMA.

The Senate shall consist of five Senators.

The Doge shall be the head of the Senate and will be responsible for its oversight.

There shall be five seats in the Senate, with it in this regard being a governing body to that particularly in number.

A member of the Senate for repeated failure to vote may be impeached by their own peers, and every Senator is encouraged to propose bills.

Subsection II: Powers

The Senate shall have all legislative authority vested in them.

Similarly, the citizenry of TMA shall possess the authority motion by the petition of five citizens to vote on any bill or amendment directly, which shall require a two-thirds majority.

The Senate shall have the power to amend the Constitution by two-thirds majority.

The Senate shall elect the Doge (speaker)

The Senate shall have the power to approve or deny a treaty.

Treaties may only be proposed by the executive.

Treaties shall exist a level above common law and a level below the Constitution.

Laws that apply punishment to offenders of crimes listed in bills before they take effect, or laws that apply punishment without due process under the trial they are entitled to, are strictly prohibited from introduction and passage in the Senate.

Subsection IV: Requirements and Selection

For any person to be elected Senator by the citizenry, the person must stay in the region for one week.

A senator who has served a term and wishes to serve another immediately after by reelection, must have proposed at least one bill during his tenure. Whether said bill was voted on or passed is irrelevant.

The Senate election shall be a Ranked Voting election.

Section V: The House of Nobles

Subsection I: Role and Structure

Three Nobles, who shall serve until removed by the Emperor, shall make up the House of Nobles.

The Nobles shall be the calm voice of criticism and opposition when needed. It may almost be thought of as a gentleman parlor.

Subsection II: Powers

The House of Nobles may be convened by either a member or the Emperor to discuss a law proposed by the Senate. It may have no sway or effect on its passage or failure, but shall serve as a place for discussion.

The main role however shall be advising the Chancellor and Emperor in weekly House Meetings.
In a House Meeting, each noble may lay out their criticisms of either the Chancellor, the Emperor, or the Senate without fear of repercussions. As long as no personal attacks, illegal or treasonous statements are made, it shall be allowed.

After each criticism, a noble is expected to advise on what to do. This is to be regarded as how the Chancellor, Emperor, or the Senate wish.

ARTICLE III: THE JUDICIARY

Section I: The High Court

Subsection I: Role and Structure

The High Court shall be the highest authority on justice and enforcement in TMA and the primary criminal authority and judicial body within the region.

The High Court shall be headed by the Chief Justice and shall be composed of Judges who will be appointed by the Senate..

The Chief Justice shall be appointed by the Chancellor and shall serve until removal by the Senate by ⅔ or resignation.

All appointments shall require the majority consent of the populace to be approved.

Subsection II: Powers and Responsibilities

The High Court shall be responsible for hearing all suits, civil or criminal, enforcement of the law, and the punishment of criminals.

The Chief Justice shall have the responsibility of presiding over all criminal trials, and a judge all civil.

The Chief Justice shall handle appeals of Civil Cases, and a trial by jury presided by either the Chief Justice or a Judge for all civil cases.

A jury shall be composed of at least three members and at most five, who shall be selected by the Chief Justice from the citizenry, with the defense and prosecution able to refuse up to two without a valid reason, and others with a valid reason (validity determined by the Chief Justice).

No citizen shall be forced to participate in the jury without that citizen’s consent.

The Chief Justice shall have the power to issue any punishments for criminal behaviour within the bounds of the law.

The law must have been in effect at the time of the occurrence of the criminal behaviour being punished.

The Emperor may stand in as an arbitrator in a judicial official's absence if needed.

Subsection III: Requirements and Selection

All Judges (the Senate may put or remove a limit at its pleasure on the needs of the region), and the

Chief Justice shall be appointed by the Chancellor and approved by the Senate with a simple majority vote.

A Chief Justice or Judge may not serve as a Chancellor or Doge during their tenure, but may be a senator, with recusals as necessary.

ARTICLE IV: ENFORCEMENT

Section I: Supremacy

Following the ratification of the Constitution, no legal document may be considered higher.

The Constitution may be ratified by the citizenry of TMA.

All laws or regulations contradicting anything within this Constitution may be struck as unconstitutional and thus null by public vote as challenged by any citizen.

Section II: Amendment

Any articles, sections, subsections, clauses, subclauses, or parts may be amended or removed and any articles, sections, subsections, clauses, subclauses, and parts may be added by the Senate through the set amendment procedure.

All amendments shall be passed with the majority of the Senate and citizenry approving via referendum.
