THE CONSTITUTION OF NORTH TURKESTAN

Section I

1.1 The name of this region shall be North Turkestan, hereafter referred to as NT

ARTICLE II: PURPOSE
Section I

2.1 The purpose of this region will be to spread Marxist and Socialist ideals peacefully through the realm of Nationstates. This region is devoted to defence against the evils of Fascism and Imperialism and hopes to bring an end to Capitalism. Ultimately, this region seeks to be an example unto the world of an effective combination of Marxism and Democracy.


Article III-GOVERNMENT
Section I

3.1 The government of NT is to be made up of citizens elected by their fellow citizens into 2 roles. These two citizens are referred to as government officials
3.2 The two democratically elected roles in government are as follows:
3.2.1 Minister of Justice – In charge of judicial affairs and the NT Legal system (see article 8) – Powers: Polls, Communications, Appearance
3.2.2 Premier – Primary leader of the region in charge of maintaining order – Powers: Appearance, Communications, Embassies, Polls
3.3 Elections for each of these democratically elected roles occur every 3 months. At this time, the consuls create a poll listing all candidates running for the specific position which remains
open for the next two days. Citizens then vote, and the candidate with the most votes wins. In the case of a tie, the Consuls decide the winner. [/tab]
3.3.1 Unless there is no opposition, any elected official may not serve more than 2 consecutive 3 month terms.
3.4 In order to obtain office, a nation must fulfill the following requirements:
3.4.1 The nation must be a citizen of NT
3.4.2 The nation must not have Fascist symbolism present on its flag
3.5 Any citizen can call for the impeachment and removal from office of a government official, so long as there is a just cause. Any citizen who wishes to impeach a government official must write a telegram to the Minister of Justice containing the reasons behind their request and valid proof. The Minister of Justice must then determine whether the proposed case is grounds for impeachment (see 3.9). If the case is deemed proper, then the Minister of Justice will publicize the accusations through a poll, hereafter referred to as an “Impeachment Poll”.
3.6 An “Impeachment Poll” will list all the charges laid out against the government official, and all the proof present to back up the claim. All citizens may then vote on the poll, and after 24 hours the poll will close. In order to be impeached and removed from office, at least 67% of all the citizens in NT (rounded down) must vote in favour of impeachment.
3.7 Any citizen who wishes to call for the impeachment/removal from office of the Minister of Justice must write a telegram to one of the Consuls and not the Minister of Justice, and the Consuls will continue with the process as described in 3.5 and 3.6.
3.8 On any one of the following conditions, a government official can be impeached and an election can be called:
3.8.1 A government official engaged in sabotage or the exchange of region secrets
3.8.2 A government official does not meet the requirements needed to obtain office
3.8.3 A government official shows intention to do deliberate harm to the region, nations within the region, or to any allied regions
3.8.4 A government official acted corruptly and/or engaged in non-publicized deals with another citizen or member
3.8.5 A government official violated the laws of citizenship as set out in Article 5
3.8.6 A government official possesses an unregistered puppet state
3.8.7 A government official does not stand for the beliefs of NT
3.8.8 A government official violated any aspect of this, the constitution of NT
3.9 The position of WA delegate is not voted on through polls, rather through endorsements
3.9.1 The WA delegate is considered an ordinary citizen and not a government official
3.9.2 The WA delegate must be a citizen of NT
3.9.3 If a member who is not a citizen of NT becomes the WA delegate, the Consuls hold the right to demand that all members and citizens of NT unendorse this nation. Those who refuse may be forcibly ejected and banned from the region by the Consuls without a trial.
3.9.4 The WA delegate does not have Executive power

Article IV-MEMBERS
Section I

4.1 A member is hereby defined as any nation located in NT, that is not a citizen (see article 5)
4.2 Members have a unique set of rights as is detailed below
4.2.1 Members are permitted to write on the RMB board, so long as they behave in a respectful manner and do not preach ideologies opposed to those of the region
4.2.2 Members are not allowed to vote in elections, vote on citizenship, run for any government position or vote in any polls
4.2.3 Members are not allowed to become the WA delegate but are permitted to endorse any citizen of NT
4.2.4 A member is not required to follow Marxist or Socialist ideology
4.2.5After two weeks of membership, any member may apply for citizenship so long as it fulfills the requirements (see article 5)
4.3 Any member who possesses an extreme Fascist, Imperialist or Capitalist ideology may be expelled by the Consuls without consultation from the citizens.
4.4 A member who violates the protocols listed in this constitution is to be ejected and permanently banned from NT at the Consuls’ Discretion.

Article V-CITIZENSHIP
Section I

5.1 A citizen is hereby defined as any nation located in NT, which has been formally accepted according to the citizenship process
5.2 In order to be eligible for citizenship, a nation must follow the criteria below
5.2.1 An eligible nation must have a Marxist, Socialist or Left-Leaning ideology
5.2.2 An eligible nation must be located in NT for at least two weeks before applying for citizenship
5.2.3 Puppet states are not eligible for citizenship
5.3 A nation wanting to become a citizen must apply for citizenship by sending a telegram to the Premier. The Premier will then create a poll in which all citizens may vote to either grant or deny citizenship. After two days the poll will close and the results will dictate whether a nation is, or is not a citizen
5.3.1 Nations who are not granted citizenship can re-apply every two months
5.3.2 In the event of a tie, the consuls must decide.
5.4 The Consuls reserve the right to veto any citizenship votes on the grounds that the proposed citizen does not follow the criteria listed in 5.2
5.5 Citizens have a unique set of rights and responsibilities detailed below
5.5.1 Citizens are permitted to write on the RMB board, so long as they behave in a respectful manner
5.5.2 Citizens are allowed to vote in elections, vote on citizenship and run for government positions
5.5.3 Citizens are allowed to vote on all judicial matters
5.5.4 Citizens are allowed to become the WA delegate
5.6 A citizen who violates the expectations listed in this constitution is to be tried by the government, as is described in Article 6

Article VI-THE LEGAL SYSTEM
Section I

6.1 The legal system is headed by the Minister of Justice
6.2 Any citizen has the right to accuse another citizen, member, or government official of violating the laws of NT
6.3 A citizen who wishes to accuse another citizen, member, or government official of violating the laws of NT must write a telegram to the Minister of Justice containing the reasons behind their accusation and valid proof. The Minister of Justice must then determine whether the proposed case is valid and has sufficient proof. If the case is deemed proper, then the Minister of Justice will publicize the accusations through a poll, hereafter referred to as a “Judicial Poll”.
6.4 A “Judicial Poll” will list all the charges laid out against the citizen, member, or government official, and all the proof present to back up the accusation. All citizens may then vote on the poll, and after 24 hours the poll will close. If a majority of the citizens of NT vote the accused “guilty”, he will be dealt the fitting punishment. If a majority of the citizens of NT vote the accused “not guilty”, he will be freed from the charges.
6.5 The rules of impeachment and the grounds on which it can be completed are described in Article 3
6.6 The following are the fundamental laws of NT and their punishments:
6.6.1 A member, citizen or government official who shares the private regional information of NT with any other nation is to be permanently banished from NT
6.6.2 A member, citizen or government official who attempts to unlawfully overthrow the governmental system of NT is to be permanently banished from NT
6.6.3 A member, citizen or government official who does not register all the puppet states in their control (See article 8) will be banished from NT for one year, and upon return they will not be allowed to control any puppet states
6.6.4 A member who attempts to vote in an election is never allowed to become a citizen
6.6.5 A citizen or government official who preaches fascist, imperialist, religious or capitalist ideologies is to be stripped of their citizenship and/or governmental position immediately
6.6.6 A member who preaches fascist, imperialist, or capitalist ideologies is never allowed to become a citizen
6.6.7 A member who poses a threat to the integrity and stability of NT is to be banished
6.6.8 A member, citizen or government official who endorses a member of NT as WA delegate is to be banished for a year.
6.6.9 A citizen or government official who uses inappropriate speech, including but not exclusive to profanity, is to be stripped of their citizenship and/or governmental position immediately
6.6.10 A member who uses inappropriate speech, including but not exclusive to profanity, is never allowed to become a citizen
6.6.11 A member, citizen or government official corrupted or modified the law code or constitution without support from the majority of citizens.
6.6.12 A member, citizen or government official being tried, is not allowed to vote in their own Judicial poll.
6.7 Once a “Judicial Poll” has closed, the Minister of Justice will announce the verdict and if the accused is found guilty, he/ she will also announce the punishment that the accused will receive
6.8 Only the Consuls permitted to perform the punishments to the accused.
6.9 A citizen or government official who wants to propose a law must send their proposal in a telegram to the Minister of Justice. The Minister of Justice must then review the law and make sure it is consistent with the constitution and values of NT. If the law is deemed to constitutional, the Minister of Justice will publicize the suggested law through a poll, hereafter referred to as a “Legal Poll”.
6.10 A “Legal Poll” will describe the proposed law and all the arguments for its creation. All citizens may then vote on the poll, and after 24 hours the poll will close. If a majority of the citizens of NT vote in favour of the law, it is passed and joins the official law code of NT. If a majority of the citizens of NT vote against the law it will not be passed.
6.10.1 If a proposed law is not passed, it may not be voted on in another “Legal Poll” for another 6 months.
6.11 A citizen or government official who wishes to repeal a law must follow the steps described in 6.9 and 6.10, and the Minister of Justice will create a “Legal Poll” for the repealment of a law.
6.11.1 A law that has been repealed will be removed from the law code.
6.12 The Minister of Justice is not permitted to propose or repeal laws and this is grounds for impeachment.

Article VII-THE CONSULS
Section I

7.1 The Consuls will always be The Communist Confederacy of The Kyrgz and The People's Republic of Fairness and Equality.
7.2The role of the Consuls is to preserve order in NT and ensure that the governmental system is working efficiently while distancing himself from the actual workings of the region.
7.3 The Consuls are permitted to veto all polls and votes; however, he must supply all citizens with a reason behind this choice.
7.3.1 If the first Consul vetoes without the input of the other, the second Consul can counter veto and let the proposed resolution come into effect.
7.4 The Consuls are the only nations permitted to carry out sentences declared through the legal system.
7.5 If one Consul is absent for more than one month, all his responsibilities by default move to the reigning Premier until the Consul returns.
7.5.1 If one Consul ceases to exists, the Premier becomes Consul. The Premier serves as Premier to the end of his term, after that, the former Premier will take on the role of Consul.
7.6 The Consuls have all the rights of a citizen but are not permitted to run for governmental positions.
7.7 The Consuls may amend the constitution with both Consuls agreement and a 66.6% in favour.

Article VIII-PUPPET STATES
Section I

8.1 A puppet state is defined as any nation which is controlled by another nation located in NT
8.2 All puppet states must be registered with a Consul through a telegram upon entry to NT. Once registered, the Consul will make public that the nation is in fact a puppet state, and will specify the nation which controls it.
8.3 A puppet state is not eligible for citizenship and has the same rights as a member
8.4 If a puppet state violates the laws of NT, it is to be permanently banished, and the nation to whom it belongs will also be punished according to the law code.
8.5 Citizens of NT may control up 2 puppet states, and members are permitted one puppet state.

Article IX-THE FUTURE AND BEYOND
Section I

1.1This constitution embodies the values, roles and functions of North Turkestan and is eternal. North Turkestan will always be living proof that democracy and Marxism can exist together. It will be a place where the proletariat is safe from the grasp of the oppressive fascists and the filthy capitalist bourgeoisie.
