MANDATE 13 – The Constitution of Lazarus

Preamble

With the intent of ensuring a stable and democratic government and community this Mandate shall serve as the Constitution of Lazarus.

SECTION 1. LAZARUS - PUBLIC POWERS

Article 1. Lazarus is a sovereign state with the right to self-determination. Lazarus and its provinces and dependencies are unalienable. The Head of State and the World Assembly Delegacy are established through legitimate succession approved by a two-thirds vote of the Assembly.

Article 2. Constitutional laws shall include the Regional Security Act, the Criminal Code Act, the Lazarene Citizenship Act, the Lazarene Elections Act, the Regional Flag Act, the Charter of the Regional Guard, the Culture Identity and Theming Act, and the Regulation of States of Emergency Act. Constitutional laws may be passed by the Executive Council by three quarters vote but may not exist in conflict with or override this mandate. The Head of State or their Seneschal may veto constitutional laws.

Article 3. Legislative power is exercised by the Executive Council and the Assembly.

Article 4 Judicial power is exercised by the Security Council and its courts and tribunals in accordance with the Regional Security Act and Criminal Code Act.

Article 5. Official Orders, titles, insignia and other distinctions shall be established in accordance with the Culture, Identity, and Theming Act. The regional flag shall exist in accordance with the Regional Flag Act.

SECTION 2. THE HEAD OF STATE

Article 6. The Head of State or their Seneschal represents Lazarus in its relations with other nations, regions, or organizations, but may delegate this authority to the Executive Council or Prime Minister. The Head of State or their Seneschal may sign and ratify or veto treaties upon their passage.

Article 7. The Head of State or their Seneschal shall hold the right to approve or rescind citizenship and residency and may grant pardons or amnesty by a 50%+1 vote of the Security Council. The Head of State may also delegate this responsibility to the Prime Minister, in which case the Head of State or their Seneschal shall have ten days within which to rescind a citizenship once granted.

Article 8. The Head of State shall establish a list of successors from within the Security Council. The Seneschal shall be the Head of State upon the resignation of the prior Head of State. The Head of State may establish the means and process for succession. The Head of State shall become a Security Councilor upon resignation or removal. The Head of State may appoint a World Assembly Delegate or Governor to a territory of Lazarus or appoint them by election in line with the Lazarene Elections Act.

Article 9. The Head of State may dismiss any Regional Guard Commander appointed by the Executive Council or the Prime Minister at will, in accordance with the Charter of the Lazarene Regional Guard.

Article 10. The Head of State may not simultaneously be the Prime Minister or administer an election in which they are a candidate.

SECTION 3. FUNDAMENTAL FREEDOMS AND RIGHTS

Article 11. Citizenship or residency shall be acquired or deprived as established by constitutional law, and freedom of religion, speech and association shall be subject to constitutional law. Citizens and residents may address petitions to public authorities.

SECTION 4. GOVERNANCE

Article 12. The government is exercised by an Executive Council, assisted by a Seneschal, or a Prime Minister, with the gracious approval of the Head of State. The Seneschal chairs the Executive Council with a casting vote alongside the Head of State. In absence of an appointment by the Executive Council or election of the Assembly, the Seneschal is Prime Minister.

Article 13. The Prime Minister and Executive Councillors are accountable to the Head of State for the administration of Lazarus and its dependencies and territories. The Head of State or their Seneschal may dismiss the Prime Minister or an Executive Councilor at will under the conditions prescribed by law.

Article 14. Executive Orders are debated and approved in the Executive Council and passed by two-thirds vote. The Head of State or their Seneschal's signature makes Executive Orders enforceable.

Article 15. Sovereign Ordinances, which are excluded from debate pertain to the organization of the regional message board, world factbook entry, regional officers, legal affairs and the direction of the Judiciary. The process by which ministerial decrees are approved or rejected and the granting of honorary titles by the Head of State or Seneschal is decided by Sovereign Ordinance.

Article 16. Ministerial decrees are debated by the Executive Council and signed by the Prime Minister or Executive Council. They become enforceable only in the absence of the Head of State's formal opposition within seven days of passage. The Head of State may inform the Executive Council or Prime Minister that they will not exercise opposition for some or all ministerial decrees, which are then enforceable when signed by the Executive Council or the Prime Minister.

SECTION 5. THE ASSEMBLY

Article 17. The Assembly comprises all citizens and approved residents of Lazarus. The Assembly shall be tasked with the passage by two-thirds vote of general laws regarding the civil, political, economic, and social policies of their fellow nations, and for regional elections where they take place in accordance with the Lazarene Elections Act. Procedural rules of the Assembly are defined by the Assembly Procedures Act, which may be amended by two-thirds vote.

Article 18. The Assembly includes district Axiarchs, elected for a three-month term under the conditions prescribed by law, unless otherwise appointed by the Executive Council by two-thirds vote with the signed approval of the Head of State. The Head of State or their Seneschal may dismiss district Axiarchs and begin a new Assembly session, which shall require a new election or appointment of those district Axiarchs.

Article 19. There shall be a district Axiarch for Axios as the capital district of Lazarus. For the purposes of the passage of general laws, each district Axiarch shall hold one vote, and the Assembly shall collectively have as many votes as there are district Axiarchs. In case of a tie the Head of State or their Seneschal may cast an additional deciding vote.

Article 20. The Head of State or their Seneschal shall be Assembly Speaker. The Head of State may appoint Deputy Speakers. The Assembly Speaker and Security Council are entrusted with the administration of electoral votes under the conditions prescribed by law.

Article 21. The Assembly Speaker may pardon or allow for judicial review of those exhibiting poor conduct in the Assembly.

Article 22. An emergency session of the Assembly may be established in accordance with the Regulation of States of Emergency Act.

SECTION 6. THE EXECUTIVE COUNCIL

Article 23. The Executive Council consists of Security Councilors. The Seneschal and Security Councilors are directly appointed by the Head of State to join the Executive Council with voting rights. The Prime Minister and district Axiarchs may be appointed at the suggestion of the Executive Council by two-thirds vote.

Article 24. The Head of State may permit the Prime Minister and district Axiarchs to attend an Executive Council session with voting rights, without the requirement of an Executive Council vote, in accordance with constitutional law and Executive Council procedures. Executive Council procedures may be established or amended by the Executive Council by two-thirds vote.

Article 25. The Executive Council or their appointed or elected Prime Minister may establish or revise ministries, ministerial appointments, and staff at will. The Executive Council may override ministerial decisions or dismiss a Prime Minister by a two-thirds vote.

Article 26. Regional treaties and declarations of war, peace, or proscriptions, are at the sole discretion of the Executive Council or their designated Prime Minister, who may send them for debate in the Executive Council for two-thirds vote.

Article 27. Appointments by the Head of State, Executive Council or Prime Minister, remain in effect, until the necessary confirmation vote or according to regional law. The Executive Council, on its own initiative, may revoke or confirm any appointment by a two-thirds vote.

SECTION 7. TERRITORIES AND DEPENDENCIES

Article 28. Territories and dependencies are administered by the legitimately appointed or elected World Assembly Delegate, and regional officers designated by the Executive Council, or border control officers by a 50% + 1 vote of the Security Council.

Article 29. Citizens of territories are Lazarene citizens, except for those deprived of the right to vote by regional law. Those not deprived of the right to stand for election due to any of the conditions set forth by law are also eligible to stand for positions.

Article 30. One Axiarch shall represent each territory in the Assembly, and the Exarchate Axiarch shall represent all dependencies at large of Lazarus.

SECTION 8. SECURITY AND JUDICIAL AUTHORITY

Article 31. Judicial power is vested in the Head of State, who delegates power to Tribunals. Tribunals render justice in the name of the Head of State and as laid down by the mandate, regional law and procedures.

Article 32. Judicial and constitutional tribunals consist of the Head of State, Seneschal, and any further justices appointed by the Executive Council by a two-thirds vote with Head of State approval, in accordance with the Criminal Code Act and Regional Security Act. Procedures for constitutional matters, criminal reviews, and legal questions may be established or amended by the justices by two-thirds vote.

Article 33. The Security Council is composed of all Security Council members and the Head of State and is convened by the Seneschal who acts as chairperson. Security Councilors shall determine or investigate the status of citizens and residents in Lazarus and its provinces and dependencies in accordance with the Regional Security Act and Criminal Code Act. Security Councilors and Justices require a 50%+1 confirmation vote in the Executive Council.

SECTION 9. REVISIONS OF MANDATE, LAW, AND APPOINTMENTS

Article 34. The Mandate and Assembly may not be suspended. Any revision of regional law or the mandate requires the joint agreement of the Head of State or the Executive Council, who may veto an amendment. In the case of sole initiative by the Assembly, proceedings for the amendment of the mandate or regional law may be taken upon the approval of two or more Axiarchs of the Assembly, after which a three-quarters majority may amend the mandate.

Article 35. Amendments, laws, regulations and treaties in conflict with the mandate as affirmed by Constitutional Tribunal, are repealed or amended through a judicial review, or as soon as reasonably possible by amendment of the Assembly or Executive Council. Any revisions of laws or procedures by the Executive Council or Assembly are sent to the Justices of the Security Council upon passage. If rejected, they cease to be in effect until amended to comply with the judicial order or by a judicial tribunal.

Article 36. Automatic removal from office shall take place when a citizen's nation ceases to exist, or in the case of the Head of State, Seneschal or a Security Councilor or leaves the World Assembly. This removal shall be automatic unless permitted a continuation by Judicial tribunal by two thirds vote affirming exceptional circumstances resulted in a citizenship nation ceasing to exist or leaving the World Assembly. Automatic removals shall also take place at the conclusion of a term or as ascribed to term limits, and no continuation in those circumstances may be given by Judicial tribunal.

SECTION 10. ADMINISTRATION

Article 37. The Head of State and Security Council will be responsible for on-site moderation of Lazarus and its provinces and dependencies, inclusive of the use of communications powers to suppress posts, and they may establish policies for the safety of those on on-site property. The mandate may not interfere with their on-site responsibilities.

Article 38. Off-site properties of Lazarus and its provinces and dependencies shall be administered by the same citizen, as root administrator. They may appoint or remove off-site moderators or administrators, and they may establish policies for the safety of those on off-site property. They may revoke or deny permissions for any reason related to off-site security or good conduct on off-site properties. They may waiver an off-site ban or restriction on a member or provide them permanent access to view non-citizen areas of off-site property. The mandate may not interfere with their off-site responsibilities.
