Formation of an Election Commission amendment act M2026/001

Article 1 – Election Commission
1. Establishment

There shall be an independent Election Commission of Mauravia, which shall be responsible for the conduct, supervision, direction, and control of all elections and referendums held under this Constitution and the laws of Mauravia.

2. Constitutional Status

The Election Commission shall be an independent constitutional body. It shall perform its functions impartially and without interference from the Executive, Legislature, or any political party. Its actions shall be subject to judicial review by the Supreme Court, and any citizen may challenge the legality of its actions through a Public Interest Litigation (PIL) in accordance with law.

3. Composition

The Election Commission shall consist of three Chief Election Commissioners. The Commission may appoint such subordinate officers and staff as are necessary for the efficient discharge of its constitutional duties. Parliament may, by law, increase or decrease the number of Commissioners in accordance with the needs of the nation.

4. Neutrality

No person shall be appointed as a Chief Election Commissioner unless they are independent, politically impartial, and capable of discharging the duties of the office without bias. Every appointment shall be subject to vetting in accordance with this Constitution and the law.

Clause 5 – Appointment

The Appointment of the Election Comissiners is done by a joint commission of a sitting Chief Justice, Leader of Opposition and the Prime Minister

Clause 6 – Term of Office

the Election Commission officer has a term limit of 2 years

Clause 7 – Removal

A Chief Election Commissioner shall not be removed from office except on the grounds of proven misconduct, corruption, bias, incapacity, or any other serious violation of this Constitution or the law.

No Chief Election Commissioner shall be removed unless the allegations have been established by credible evidence and approved by a resolution passed by not less than a two-thirds majority of the total membership of the Senate.

Clause 8 – Powers and Functions

The Commission shall:
conduct elections and referendums;
prepare and maintain the electoral roll;
announce election schedules;
supervise polling and counting;
declare official election results.

Clause 9 – Electoral Roll

The Election Commission shall prepare, maintain, and periodically revise the electoral roll of eligible voters in accordance with this Constitution and the law.

Clause 10 – Independence

Parliament, the Executive, political parties, public authorities, or any other person shall not direct, interfere with, obstruct, or improperly influence the Election Commission in the exercise of its constitutional functions.

Any person, political party, public authority, or organization found, in accordance with law, to have unlawfully interfered with the independence or functioning of the Election Commission shall be liable to such penalties as may be prescribed by law, including fines, temporary suspension of political activities, disqualification from electoral participation, or other appropriate sanctions.

Where a political party or organization repeatedly or deliberately engages in serious interference with the constitutional independence of the Election Commission, the Supreme Court may, in accordance with law, order such further sanctions as are necessary, including suspension or dissolution where constitutionally justified.

Clause 11 – Regulations

The Commission may issue regulations, guidelines, and instructions necessary for the conduct of elections, provided they are consistent with the Constitution and the law.

Clause 12 - Registration of political parties

(i) Any association of citizens wishing to participate in the electoral process as a political party shall apply for registration with the Election Commission of Mauravia. The application shall include:

(a) proof of citizenship of its founding members;

(b) the political party's manifesto;

(c) the political party's chosen name and symbol;

(d) the Political Party Oath; and

(e) such other documents as may be prescribed by law.

(ii) No political party shall be registered unless it has not fewer than five founding members.

(iii) Upon being satisfied that the requirements of this Constitution and the law have been fulfilled, the Election Commission shall register the political party. A registered political party shall become eligible to contest elections beginning with the next scheduled electoral cycle following its registration.

Clause 13 - Election Schedule

The Election Commission shall announce the election schedule, polling dates, counting of votes, and declaration of results in accordance with this Constitution and the law.

Clause 14- Election Symbols

The Election Commission shall allot, regulate, and protect the election symbols of registered political parties and independent candidates in accordance with the law.
