Statement Of The Erosian Senate

This document outlines the powers, abilities, rules, restrictions, function, operation, and use of the Erosion Senate.

Please note that the following is not ranked in order of importance and is purely numbered for simplicity.

Powers and Abilities of the Senate of Eros;

The senate in a majority vote with an official senate inquiry may dismiss the President of Eros from their position and the chairman can either hold a new election for president, appoint the vice President to serve out the rest of the term or to appoint any officer as president with the exclusion of the Eternal Founder.

If the President is removed from the senate they may not re-run and are barred from entering elections as any kind of candidate

The senate may, with a one third vote, call any officer including but not limited to the Secretary General, president or eternal founder into question, interrogation, investigation or condemnation.

The Senate has Reserved the exclusive rights to create, amend, change or remove any law as long as the proposal follows the proposals act of 2021 and the senate is in a majority vote. This does not impact the court's ability to create common law

The Senate with a majority Vote may subdue the Supreme Commanders powers or override their laws (this does not take effect during martial law).

Anything not mentioned in this document the senate can control with a majority vote.

The Senate may Dismiss any officer with a majority vote and reasonable grounds including but not limited to the Supreme Commander based on an official senate inquiry. The chairman may appoint any new Erosian state to serve the position.

Marshal Law (please note any parts of section 2 are only in use when the Secretary General declares martial law ;

During Martial Law the senate may not call upon section 1, b in relation to the Secretary General. Section 1, d must be amended to a two thirds vote.

The senate must relinquish its exclusive rights in section 1, c, the senate my still act upon section 1, c but the rights will be shared between the senate and Supreme Commander

The Courts relation with the senate;

The senate in part relinquishes their rights to section 1, c and allows the courts to create common law

The senate may not enquire into the court unless the senate is in a majority. If the inquiry relates to a member of the senate there votes or any votes related to them will be disregarded

A senate inquiry may result in it being forwarded to the courts, this requires a one third vote

The Regional Court of Eros may Edit the ‘Statement of the Erosion Senate’ in a two thirds vote

Senate Inquiry;

A senate inquiry is as defined in section 1, b

The senate may inquire into any officer in a one third vote on the stance of corruption, tyranicalism, inefficiency, bribery, uselessness and no confidence.

A senate inquiry can be into anything not specified but only in a majority vote

A senate inquiry should involve the E.S.I.A to collect evidence and information for the inquiry and the regional Court to present hearings and a final decision for the said inquiry

Restrictions of The senate:

The senate may not Dissolve itself

The senate may NOT change the ‘Statement of the Erosion Senate’ The management of this document is outlined in section 3, d

The senate may inquire into the eternal leader as defined in section 1, b but may not dismiss the eternal founder

In turn for section 5, c the eternal founder may not use their executive abilities to dissolve the senate or take control of the courts

Senate Members;

Every nation in Eros is deemed a ‘senate member’ this role does nothing for the nation except acknowledge that they are part of eros and must follow erosion senate and common law

A Permanent seat on The Erosion Senate may not be taken back by the senate and counts as one vote, only the member state may take back there permanent seat, unless the chairman and a two thirds of the senate agrees to rescind the nations permanent seat.

The Chairman of the senate holds the rights to call the senate, dismiss the senate (only for individual meetings not entire dismissal), hold votes, chair the senate, keep the senate in order, and must have a permanent seat on the senate, and may use their discretion at times. The Chairman is a LIFETIME POSITION and can only be appointed by the court or the Eternal founder.

Nations that are combined, received or included into larger nations (the chairman's discretion defines what this means, unions that are not single nations do not count) only count as one individual vote, if a nation wants to join a larger nation or similar Union, group or alliance (once again at the chairman's discretion) they must relinquish their permanent seat on the senate.

The President has NO senate preference, The President may however if they feel necessary remove any Permanent Members from voting (only for the current vote there voting powers will resume after the current vote) and appoint themselves 2 added votes, they can also bring forward any issues or acts for senate voting and can call the senate but not dismiss them or run voting. The President is Required to sign off on all senate bills, acts and legislation

Please note that the President does not represent the senate in any way and the figurehead of the senate is the chairman

Operation;

The senate does not require any Authorisation other than its own to pass laws (excluding times of marshal law please refer to section 2)

The senate does not rely on any kind of lower house to run

Wars;

The senate may end wars with a three fifths vote if the wars is deemed a threat to regional security, a threat to region wide trade (this excludes nations fighting, allied with or aiding in said war), threat to neutral nations and potential breaking of the “Erosian Conventions of Wars act of 2021”.
