Inferno Stellaria Laws


Preamble

This document is a treaty between the Stellar Phoenix and the inhabitants of the land that outlines the rights of the inhabitants of the land under the protection of the Stellar Phoenix. The Articles of Inferno Stellaria shall be the highest law of the land and no other law may take precedence over or be in conflict with the Articles.


The Articles of Inferno Stellaria

  1. Freedoms

    1. All residents of Inferno Stellaria have the right to exercise their freedoms of speech, independent press, and movement.

    2. All residents of Inferno Stellaria have the right to a fair and just trial for any violation of the laws and cannot be punished without due cause.

    3. All residents of Inferno Stellaria have the right to vote in any way they wish on matters pertaining to Inferno Stellaria.

    4. All residents of Inferno Stellaria have the right to join and leave the World Assembly as they please should they remain under the designated endorsement cap.

    5. All residents of Inferno Stellaria have the right to participate in the government of Inferno Stellaria.

    6. All residents of Inferno Stellaria have the right to join community events and roleplaying.

    7. These rights cannot be infringed upon by legislation or executive acts. However, the Founder and designated Administrators may act in ways that would otherwise infringe upon these rights to uphold administrative rules, laws, and Terms of Services.


  2. Separation of Powers

    1. No individual may hold more than one of the following positions: Regio Stellaris, Speaker, Chief Iustitia, and Praetor.


  3. The Executive

    1. The Executive Branch of Inferno Stellaria includes the Stellar Phoenix, the Regio Stellaris and three Praetors of Internal Affairs, Cultural Affairs, and Foreign Affairs, all of which have Regional Officer spots.

    2. Each executive term lasts for six months.

    3. At the end of each term, the Stellar Phoenix either appoints a new executive or reappoints the previous executive.

    4. The Stellar Phoenix

    5. The Stellar Phoneix is the Founder of Inferno Stellaria and the Head of State.

    6. The Stellar Phoenix appoints the Regio Stellaris and the Chief Iustitia, subject to confirmation by a simple majority vote by the Legislature.

    7. The Stellar Phoenix holds ceremonial powers within the government of Inferno Stellaria, including but not limited to opening and closing ceremonies, holding elections, and signing any items passed through the Legislature.

    8. The Stellar Phoenix may appoint a successor, who is to be confirmed by the Legislature with a three-fourths supermajority vote in favor.

    9. Should the Stellar Phoenix disappear without an appointed successor and the founder account Cease-To-Exist, the Regio Stellaris automatically assumes the position of Stellar Phoenix and must refound the region. In such an event, a confirmation is not required.

    10. The Regio Stellaris

    11. The Regio Stellaris is the Head of Government and is appointed by the Stellar Phoenix every six months.

    12. The Regio Stellaris is the World Assembly Delegate of Inferno Stellaria.

    13. The Regio Stellaris holds appearance, embassies, border control, communication, and polls powers.

    14. The Regio Stellaris appoints the Praetors who shall be the official heads of Internal Affairs, Foreign Affairs, and Cultural Affairs, to be confirmed by the region with a simple majority of the vote.

    15. The Regio Stellaris may establish additional portfolios, dissolve portfolios, and appoint any number of deputies or officers to fulfill those portfolios. Such actions must be confirmed by a simple majority vote of the Executive.

    16. Praetors

    17. The Regio Stellaris appoints three Praetors following the conclusion of the Regio Stellaris' confirmation vote.

    18. The Praetor of Internal Affairs is responsible for maintaining the region's infrastructure and recruitment, holding appearance and communication powers.

    19. The Praetor of Cultural Affairs is responsible for promoting the culture of Inferno Stellaria, hosting events and contests for the region as they see fit, as well as safeguarding and promoting the regional culture, holding appearance, communication, and polls powers.

    20. The Praetor of Foreign Affairs is responsible for promoting the region abroad to other regions and maintaining diplomatic ties to other regions, holding appearance, communication, and embassy powers.

    21. Any action that a Praetor may take that involves a change to the World Factbook Entry or mass telegramming must be explicitly approved by the Stellar Phoenix and the Regio Stellaris.


  4. The Legislature

    1. The Legislature of Inferno Stellaria is comprised of all Residents of Inferno Stellaria.

    2. The Legislature is chaired by the Speaker, who is to be elected from amongst the membership of the Legislature every four months. The Speaker is tasked with moderating debates over items presented to the Legislature and enforcing any Standing Order or Procedural Rules the Legislature may so enact.

    3. The Legislature may write and pass bills, amendments to the Articles and other laws, and resolutions.

    4. For the purposes of these Articles, an "item" refers to anything that is brought under the power of Section II.c of the Articles.

    5. Any item passed by the Legislature that concerns Constitutional matters requires a minimum of a week of debate, and a week-long vote via a regional poll open to all residents, requiring at least a two-thirds supermajority to pass.

    6. All other items passed through the Legislature requires a minimum four days of debate and a four-day vote via a regional poll open to all residents, requiring a simple majority to pass.

    7. The Speaker holds a Regional Officer position with appearance, communication, and polls powers.

    8. Constitutional Laws

    9. Any items that affects the direct governance of the region or the Articles are Constitutional matters.


  5. The Atrium

    1. The Justice System, henceforth known as the Atrium, is comprised by a Chief Iustitia and two Associate Iudices.

    2. The Chief Iustitia is appointed by the Stellar Phoenix and has to be confirmed by the Legislature with a simple majority vote.

    3. The Chief Iustitia appoints 2 Associate Iudices, to be confirmed by a simple majority vote by the Legislature.

    4. Any resident of Inferno Stellaria is eligible to be appointed as an Associate Iustitia.

    5. The Iudices serve until they resign, leave the region, or are recalled by the Legislature.

    6. The Atrium serves to answer legal questions concerning the current laws of Inferno Stellaria and hear criminal cases.

    7. The Atrium exclusively holds the judicial power in Inferno Stellaria.

    8. Should someone be found guilty of crime in Inferno Stellaria, the Atrium has the power to administer a sentence with the approval of the Stellar Phoenix.

    9. The Atrium is empowered to resolve any conflicts in laws in the least disruptive way possible.
