Civil Code Act 2021

Article I – Definitions
  1. Banishment shall be defined as being banned from the region and Discord.

  2. Confidential information shall be defined as any information pertaining to regional security.

  3. Ejection shall be defined as being ejected from the region and Discord.

  4. Impeachment means being stripped of one or more government and government staff offices.

Article II – Civil Offences
Chapter I – Harassment

  1. Harassment shall be defined as:

    1. Unwanted publication and circulation of content of a pornographic or sexual nature towards any citizen; or

    2. Pressuring any citizen to share content of a pornographic or sexual nature; or

    3. Intentionally attempting to make another citizen’s experience in the region uncomfortable in any other way.

  2. The maximum penalty shall be the revocation of citizenship for two months from the date that the sentence is handed down.

Chapter II – Court Partiality

  1. Court Partiality shall be defined as:

    1. Any provable bias by a praetor.

  2. For the purposes of section 1, subsection a, praetor includes the Primus Praetor.

  3. The maximum penalty shall be banishment. If the praetor is not banished, they shall be impeached.

Chapter III – False Legal Accusations

  1. False Legal Accusations shall be defined as:

    1. Intentionally charging a person with a crime that the person doing the accusing knows they are not guilty of.

  2. The maximum penalty shall be impeachment.

Chapter IV - Slander

  1. Slander shall be defined as:

    1. Making a false accusation against someone in a way not covered under Chapter III, with the intention of damaging their reputation or credibility.

  2. The maximum penalty shall be impeachment.

Chapter V – Breach of Confidentiality

  1. Breach of Confidentiality shall be defined as:

    1. A breach of privacy by sharing private messages without the consent of all parties involved.

  2. Section 1 does not include the crimes covered under the Criminal Code Act 2021 Article II, Chapter II, section 1, subsection d, and Article III, Chapter I, section 1.

  3. The protections found in Article VIII, section 11 of the Constitution apply to section 1.

Chapter VI – Discrimination

  1. Discrimination shall be defined as:

    1. Any intentional discrimination that is without reasonable grounds.

  2. An example of reasonable grounds is refusing to appoint someone to a specific position due to a conflict of interest.

  3. The maximum penalty shall be the revocation of citizenship for no more than two months from the day that the sentence is handed down.

Article III – Miscellaneous
Chapter I – The Applicability of Mens Rea

  1. The common law principle of mens rea does not apply in the Freedom Isles. The exception to this is intention is explicitly included as an element of an offence.

Chapter II – Hierarchy of Penalties

  1. The hierarchy of penalties includes the following in the order listed:

    1. Banishment.

    2. Ejection.

    3. Revocation of citizenship.

    4. Impeachment.

    5. Warning.

Chapter III – Magistracy to Consider Past Convictions as Aggravating Factors

  1. When considering what sentence to hand down, the Magistracy has the ability to consider any past convictions that a person has received as aggravating factors.
