Constitution of India

PREAMBLE

We the residents of India, to keep order and peace in this longstanding community, hereby establish this legislation as the supreme law of the region. It shall outlive the reign of all Delegates to come; let the Constitution of India be a permanent guide to all present and future residents.We the people of India,agree to the constitution and pledge to protect and follow it.We hereby adopt this constitution on 24 Feb 2019.

Article One: Office of The Delegate

Section 1: All powers to change and control India shall be vested in the elected Delegate of India, and shall act as Sovereign Overseer of the region.

Section 2: The Delegate shall have the power to eject and ban any nation that is perceived to threaten the security or cause general upset to the region. No nation from any invader or raiding region shall be allowed into India.

Section 3: The Delegate is allowed to set a regional password, but only in times of dire emergency. The Delegate is not allowed to set a password to simply protect their own interests.India is open to all nations* (see Article 2).

Section 4: A Delegate can only come to power via fair and open elections or by default. Any other means of attaining power shall be considered illegal, and the soon-to-be Delegate's votes will automatically be considered illegitimate. Only citizens of India may vote, and the Delegate is not allowed to create multiple accounts in order to sway the votes in their favor. Any attempt to do so will be considered fraud, and the puppets will be banned and ejected.

Section 5: The Delegate cannot suppress posts on the Regional Message Board. Only posts considered spam/recruitment, obscene or outright offensive may be suppressed.

Section 6: The Delegacy shall run for three months. After that the Delegate can choose to run again as many times as he/she pleases.

Section 7: The Delegate has the right to open and manage embassies with any region in the world, but has no right to enter/break in alliance with foreign regions without the support of Cabinet Members.However the Delegate also has the right to suppress the posts of any member of a foreign region that threatens the sovereignty of India.

Section 8:To add a regional tag,the delegate must pass a bill in the Parliament.

Article Two: Executive Ministries

The Executive Ministries are responsible for carrying out the tasks, and responsibilities passed down from the WA Delegate.

Section 1:The Prime Minister will act as the Chief of Staff, and serve as the middle communicator between the WA Delegate, and the Cabinet Ministers.

Section 2: The Ministry of Foreign Affairs is responsible for handling all FA matters. The WA Delegate is charged with creating, or modifying the standing orders for the Ministry, appointing a Minister to oversee the responsibilities of the Ministry, and setting up an agenda for the Ministry.

Section 3:The Speaker of the Parliament has the duty to maintain decorum of the Assembly.He/She has also the right to temporarily eject a parliament member,by using the in-game-mechanics button called 'ban'.It is not compulsory to issue a notice to the culprit.He/She must conduct every poll to decide the fate of a proposed Bill on the RMB itself,where only admins can vote.When the speaker signals to start voting,members can only post 'Ayes' or 'No' in the RMB and nothing else.After 24 hours the votes will he counted by the speaker and formally announce the fate of the bill.

Article Three: Regional Crisis

Article Three sets up provisions, and protections in the region.

Section 1: If the WA Delegate Ctes, or leaves the region, the Prime Minister assumes the office of Delegate. If there is less than two months of the term, the acting Delegate will finish out the term. If there is more than two months remaining, there will be a special election.

Section 2: This section hereby creates the Emergency Electoral Council. The Council is made up of former elected, and legal WA Delegate's. Their primary purpose is to,
-Take over the Delegacy if the Prime Minister is not available, rogue, or feel they are incompetent to hold the office.
-The Electoral Council may appoint a temporary Delegate for no longer than 45 days. During the 45 day period, they must host an election for a new Delegate.
-The Emergency Electoral Council will be headed by the most senior, and active member. (Currently: Upper Calcutta)
-They do not have to hold a Regional Officer position. This is a title granted to them by the constitution.
-The Committee may vote to add other former Delegates after this list is finalized.
-The Emergency Electoral Council is made up of Pratapgadh, Chattrapati shivaji maharaj, Hindu mahasabha, Upper Calcutta.

Section 3:The Ministry of Home Affairs will work to promote cultural and other Indian activities to citizens and residents, and encourage participation in such activities. When an activity will be open to members of other regions, the Internal Affairs Minister will work with the Foreign Affairs Minister to promote those activities to other regions. They will moderate the Role Play section of the off-site forum, appoint an editor for “Sarvottar Bharat” newspaper (सर्वोत्तर भारत)and gauge the interest of the citizenry of various events and run new events based on citizen interest.

Section 4: Endorsement Cap Policy:

(i) The WA Delegate should hold the maximum number of endorsements in the region.

(ii) The Prime Minister should hold the second highest endorsement,with 80% of the total WA Delegate Endorsements.

(iii) All other regional members are not allowed to hold more than 72% of the WA Delegate Endorsements.

(iv) If during any emergency situation,where any officer/regional member is getting close to the endorsement cap of WAD,notice will be issued to the nation and it must act within 20 hours to resolve the problem,failure to do so may result upon ejection.

Article Four: Resident's Rights

Section 1: All resident nations are allowed to manage themselves however they see fit. No regulations shall be imposed on the player to change the way they wish to operate their own nations.

Section 2: All citizens have the right to participate in elections and polls. The Delegate has no power to restrict any nation from doing so, and if attempted the residents have the right to remove the Delegate from power.

Section 3: All nations, if not hailing from an invader region, have the right to stay in or leave India. The Delegate has no power to restrict them from doing so.

Section 4: The citizens have the right to add laws to this Constitution through fair polls. And alternatively they shall have the right to remove this article from legitimacy through a fair poll. citizens also have the right to alter, remove, or add new laws to this Constitution through fair elections.

Section 5:All residents of India will have the right to citizenship providing that they declare citizenship via an oath on the RMB by issuing a dispatch, maintain a nation in India and satisfy the following requirements. (a) Maintain a World Assembly (WA) member nation in India which endorses the Delegate.However,exceptions also be made under the WA Delegate's and Prime Minister's authority after a state clears the reason for not having a WA tag.

Section 6:Residents may not be made citizens during an on-going election cycle.

Section 7:A resident will only be called as a citizen,if he/she has cleared all the eligibility criterias and filled up the citizenship form.The last decision of approving any citizenship form lies upon the WA Delegate.

Section 8:Only citizens are allowed to vote in a poll.

Article Five:The Parliament House

Section 1:The Parliament House of India is composed of:

1.The Founder

2.The WA Delegate

3.The Prime Minister

4.The Speaker

5.The Foreign Minister

6.The Home Minister

7.The Sports Minister

8.The Leader of Opposition

9.The Third Front Member/The Second leader of Opposition

10.Any other officer(s) on the admin pannel authorised by both WA Delegate and Speaker

(Opposition:Defined as the party which has 0 members on the admin panel except the one who holds the title of opposition leader)

Section 2:Decorum of the House

(a)The Speaker brings proposals to the floor, facilitates discussion and conducts voting.

(b)If the Speaker is unavailable, the Delegate or his designee will act as Speaker until they become available.

(c)All discussion shall be conducted in a considerate, collegial manner.

(d)If the Speaker feels that a citizen is not behaving in a manner consistent with the decorum that is expected, that citizen will be warned. If they continue to transgress, the Speaker may remove their offending posts and remove the offending citizen from that discussion.

Section 3:Legal Procedures

(a)Any citizen may bring a proposal to discussion before the Parliament House, by requesting a member of parliament* (see section 1) to produce it in the appropriate forum.

(b)A discussion period of four (4) days, beginning at the time a proposal is posted, will be required before any proposal may be motioned to vote by a citizen. Another M.P. must second the motion before the proposal can be brought to vote by the Speaker.

(c)A proposal may be withdrawn by the M.P. who submitted it, any time before the voting period begins. A proposal that has been inactive on the floor for fourteen days without discussion, and has not been motioned to vote and seconded, will be withdrawn from the floor by the Speaker.

(d)Abstentions will not be used to determine the outcome of any vote.

(e)The Speaker may only cast a vote to break a tie.

Article Six:Ammendment of the Constitution

Section 1:Any changes including adding,removing or editing the Constitution must go through the steps.First the bill must be produced by the concerned M.P.The Bill should be passed through all the legal procedures* (see Artcile 5,section 3) and voting.

(b)While dismissing the constitution it first must be accepted by a majority via a poll,in the region,where all citizens,not residents,will be entitled to vote.Next it must go through all the legal procedures in the parliament.
