Court act

Preamble
To insure no nation ever is punished without reason and that justice is forever served within the union and without this act of the general assembly shall hereby create an interegional court known as Judicium.
Definitions
The Union shall refer to union of liberal nations.
The court shall refer to Judicium.
Member regions shall refer to regions that recognize the court as the official regional court.
Article I. Membership
A.
The Union shall automatically be a member of the court.
B.
Other regions may join if they meet the following criteria
  • Have at least 5 non puppet nations

  • Respect the rule of law

  • Agree to respect the decisions of the court


All they must do is announce there intention to join. Then if 3 judges agree and no more then 2 judges disagree that they meet all of the criteria they shall officially become members.
Article II. Initiating a court case
A.
All member regions should have a penal code or a group of laws which all nations must follow. If a region is still developing and does not have one they may follow the standard penal code issued by the court. The penal code in question will be made up by all of the judges soon after the passing of this act and updated on a monthly basis if need be.
B.
If a nation believes another has violated the law of a member region (well in there jurisdictions) they may charge them with a crime. Afterwards a judge (not effected by the violation in any way) will organize a court case where both the prosecutor and violator may be present or there chosen legal representatives may be present
Article III. The jury
A.
All member regions should give the court a list of nations which may act as jurors in there region.
B.
Once a court case has initiated the judge operating the case may choose a independent jury of at least 5 from any of the member regions based on the lists given.
C.
Members of the jury will be unknown to all but the Judges of the court and the jurors them self.
Article IV. Judges
A.
The government of each member region may appoint judges through there own process.
B.
Judges shall be trusted to know the legal system of member regions which they are dealing with.
Article V. Court cases
A.
At the beginning of the court cases both the prosecutor and suspected violator or there legal representatives may make some introductory remark. Afterwards they may debate the innocence or guilt of the suspected violator with both sides periodically calling witnesses and the judge moderation discussion.
B.
Once the judge believes debate is over or both sides finish there debate the jury may discuss among them self and vote if the suspected violator is guilty or innocent. If the jury votes innocent the case is over. Otherwise the Judge will make a list of suitable punishments based on the legal code of the region where the crime was committed. Then the jury may vote on which punishment is suitable with the judge breaking ties.
Article VI. The union
A.
The union will send the federal councilors to be judges and it will be there duty to maintain the list of suitable jurors for the region.
B.
Within 20 days from the passing of this act the union must have proposed a penal code for itself.
